OBJECT AND SCOPE OF APPLICATION

This legal text regulates the General Conditions of access to the Contents and all the Services offered by FIDALSA INTERNATIONAL GROUP on its web pages, as well as the regulation of comments, news and articles, blogs, chats and any other, and the use thereof by Users.

However, FIDALSA INTERNATIONAL GROUP reserves the right to modify the presentation, configuration and content of the Websites and Services, as well as the conditions required for access and/or use. Access to and use of the Contents and Services after the entry into force of their modifications or changes in the conditions implies acceptance thereof.

Likewise, access to certain content and the use of certain services may be subject to certain particular conditions that, depending on the case, will replace, complete and/or modify these general conditions of use, prevailing, in case of contradiction, the contradictory terms of the particular conditions over the general conditions. In this case, the User must carefully read the particular conditions created, if applicable, for this purpose by FIDALSA INTERNATIONAL GROUP.

Accessing, browsing and using the Websites implies acceptance by the User of this Legal Notice and the Conditions of Use that include it.

In this sense, a User shall be understood as any person who accesses, browses, uses or participates in the services and activities, whether free of charge or for a fee, carried out on the Website.

ACCESS.

Access to the Contents provided by FIDALSA HOLIDAYS on its sites is free of charge, accessing information and services related to its promotions, through its direct display or through technical devices of links to other Internet websites.

Access to the Websites by minors is prohibited, unless they have the prior and express authorization of their parents, guardians or legal representatives, who will be considered responsible for the acts carried out by the minors in their care, in accordance with current regulations. In any case, it will be presumed that access by a minor to the Websites has been made with the prior and express authorization of their parents, guardians or legal representatives.

Access and browsing through the Websites does not require Registration. However, to access certain services, prior registration or identification in the “User/Client/Traveler Area Registration” of the Website will be required by the User’s selection of an identifier and password.

The password, personal and non-transferable, must be generated by the User in accordance with the rules of robustness and complexity established at any time by FIDALSA HOLIDAYS. The password created by the User will have an unlimited temporary validity.

The password will be personal and non-transferable. The User undertakes to make diligent use of their password and keep it secret, not transmitting it to any third party and not even to FIDALSA HOLIDAYS itself. Consequently, the User will be responsible for the illicit use of the Websites by any illegitimate third party, who uses a password for this purpose due to non-diligent use or loss of the same by the User.

By virtue of the foregoing, it is the User’s obligation to immediately notify the managers of the Websites of any event that allows the improper use of identifiers and/or passwords, such as theft, loss, or unauthorized access to them, in order to proceed with their immediate cancellation. Until such events are communicated, FIDALSA HOLIDAYS will be exempt from any liability that may arise from the improper use of identifiers or passwords by unauthorized third parties.

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS.

The Websites are governed by Spanish laws and by national and international legislation on intellectual and industrial property.

The Websites are the property of FIDALSA HOLIDAYS and the Intellectual Property rights and rights of exploitation and reproduction thereof, of its pages/sites, screens, the information they contain, their appearance and design, as well as the links/hyperlinks that are established from it to other web pages of any company belonging to FIDALSA INTERNATIONAL GROUP are the exclusive property of the latter unless otherwise specified.

In no case shall it be understood that the access and browsing of the User through the Websites or the use, acquisition and/or contracting of goods or services offered through them, implies a waiver, transmission, license or total or partial assignment of said rights by FIDALSA HOLIDAYS.

FIDALSA INTERNATIONAL GROUP reserves all Intellectual and Industrial property rights over the text, images and other materials. The Information published on the portals mentioned in the header of this document belongs exclusively to FIDALSA HOLIDAYS or is published on it with the authorization of its owner. Reproduction, distribution, use or any other exploitation, total or partial, of the Information contained in this document without the prior authorization of FIDALSA HOLIDAYS is prohibited.

USE OF THE PAGE.

The User undertakes to use the Services provided by the Websites in accordance with the law and these General Conditions. The User undertakes to refrain from using the Services for illicit purposes or effects or contrary to the provisions of the General Conditions.

By using the Services, the User expresses their agreement with these General Conditions, undertaking not to use them to defame or insult, or carry out activities that contain false information, that are inappropriate, abusive, harmful, pornographic, threatening, damaging the public image or the private life of third parties or that for some reason infringe any law.

  • are protected by any intellectual or industrial property rights belonging to third parties, without the User having previously obtained from their owners the necessary authorization to carry out the use they make or intend to make;
  • violate the business secrets of third parties;
  • are contrary to the right to honor, personal and family privacy or the image of people;
  • infringe the regulations on the secrecy of communications;
  • cause, due to their characteristics (such as format, extension, etc.) difficulties in the normal functioning of the Services.

LICENSE ON COMMUNICATIONS.

In the event that the User sends information of any kind to FIDALSA HOLIDAYS through the Websites, through the channels provided for this purpose, the User declares, guarantees and accepts that they have the right to do so freely, that said information does not infringe any intellectual property, trademark, patent, trade secret, or any other right of third parties, that said information is not confidential and that said information is not harmful to third parties.

The User acknowledges assuming responsibility and will hold FIDALSA HOLIDAYS harmless for any communication that they provide personally or in their name, said responsibility reaching without any restriction the accuracy, legality, originality and ownership thereof.

RESPONSIBILITIES AND GUARANTEES.

Products and prices policy: FIDALSA HOLIDAYS reserves the right to modify the prices and specifications of the goods and services that are advertised on the Websites, if this is necessary. Therefore, the information given about real estate activity: homes, premises, warehouses, plots, promotions, etc., is merely indicative and of a general nature, being subject to possible changes.

Certain furniture that appears in the plans, including those of the kitchens, may be merely decorative, so FIDALSA HOLIDAYS assumes no responsibility for discrepancies between the published images and the final furniture of the property.

The surfaces expressed are approximate and may undergo modifications in the case of promotions, for reasons of a technical nature in the development of execution of the works. (For informational purposes, the useful surface is understood to be the own surface; and the constructed surface, which includes the proportional part of common elements).

For the purposes of all of the above, FIDALSA HOLIDAYS, warns that the information collected on the Websites may be incomplete, outdated or incorrect, so it is not responsible, either directly or subsidiarily, for the damages or losses that may arise from said information. However, and in order to avoid them, FIDALSA INTERNATIONAL GROUP recommends verifying the information obtained through the Websites in the places specified in each specific case. In particular, to collect all the information referred to in Royal Decree 515/1989, of April 21, on the protection of Consumers regarding the information that must be provided in the sale and rental of homes, you should contact the development companies that are specified.

FIDALSA HOLIDAYS cannot guarantee the reliability, usefulness or veracity of the services or information provided through the Websites, nor the usefulness or veracity of the documentation of the events that can be consulted through the Websites.

Consequently, FIDALSA HOLIDAYS does not guarantee or take responsibility for: (i) the continuity of the contents of the Websites; (ii) the absence of errors in said contents or products; (iii) the absence of viruses and/or other harmful components on the Websites or on the server that supplies it; (iv) the invulnerability of the Websites and/or the impregnability of the security measures adopted therein; (v) the lack of usefulness or performance of the contents and products of the Websites; (vi) the damages or losses caused, to oneself or to a third party, by any person who violates the conditions, rules and instructions that FIDALSA HOLIDAYS establishes on the Websites or through the violation of the security systems of the Websites.

Nevertheless, FIDALSA HOLIDAYS declares that it has adopted all the necessary measures, within its possibilities and the state of technology, to guarantee the functioning of the Websites and avoid the existence and transmission of viruses and other harmful components to Users.

If the User becomes aware of the existence of any illicit, illegal content, contrary to the law or that may constitute an infringement of intellectual and/or industrial property rights, they must immediately notify FIDALSA HOLIDAYS so that it can proceed to adopt the appropriate measures.

In the event that on the Websites the User could find links to other web pages through different buttons, links, banners, etc., these would be managed by third parties. FIDALSA INTERNATIONAL GROUP does not have the power or human or technical means to know, control or approve all the information, content, products or services provided by other websites to which links may be established from the Websites of FIDALSA HOLIDAYS.

Consequently, FIDALSA HOLIDAYS cannot assume any responsibility for any aspect related to the website to which a link may be established from any of its websites, regarding its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents, in general.

In this sense, if users have effective knowledge of the illegality of activities carried out through these third-party websites, they must immediately notify FIDALSA HOLIDAYS so that the access link to it can be disabled.

DURATION AND MODIFICATION.

FIDALSA INTERNATIONAL GROUP may modify the terms and conditions stipulated here, totally or partially, publishing any change in the same way in which this Legal Notice appears or through any type of communication addressed to users.

The temporary validity of this Legal Notice therefore coincides with the time of its exposure, until it is totally or partially modified, at which time the modified Legal Notice will become effective.

Regardless of the provisions of the particular conditions, FIDALSA HOLIDAYS may terminate, suspend or interrupt, at any time and without prior notice, access to the contents of the page, without the user being able to demand any compensation. After said termination, the prohibitions on the use of the contents set forth above in this Legal Notice will remain in force.

GENERALITIES.

The headings of the different clauses are for informational purposes only and will not affect, qualify or expand the interpretation of the Legal Notice.

In the event of any discrepancy between the provisions of this Legal Notice and the particular conditions of each specific service, the provisions of the latter shall prevail.

In the event that any provision or provisions of this Legal Notice is (are) considered null or inapplicable in its entirety or in part by any competent Court, Tribunal or administrative body, said nullity or inapplication will not affect the other provisions of the Legal Notice.

The non-exercise or execution by FIDALSA HOLIDAYS of any right or provision contained in this Legal Notice will not constitute a waiver thereof, unless acknowledged and agreed in writing by them.

JURISDICTION.

The relations established between FIDALSA HOLIDAYS and the user will be governed by the provisions of current regulations regarding applicable legislation and competent jurisdiction. However, for cases in which the regulations provide for the possibility for the parties to submit to a jurisdiction, FIDALSA HOLIDAYS and the user, expressly waiving any other jurisdiction that may correspond to them, will submit any controversies and/or litigation to the knowledge of the Courts and Tribunals of the city of Alicante.
